Welcome to SafeSell.au. These Terms & Conditions explain how Safe Sell Pty Ltd (“SafeSell”, “we”, “us”, “our”) provides vessel sale facilitation, trust account handling, inspections coordination, and transaction support.
By using our website or engaging SafeSell to assist with a vessel sale or purchase, you agree to these Terms.
1. About SafeSell
SafeSell helps buyers and sellers complete private boat transactions with greater structure, transparency, and confidence.
Our services may include:
- Holding purchase funds in a designated trust account
- Coordinating vessel inspections through independent providers, including SeaWorthy Inspections
- Assisting with identity verification and transaction checks
- Coordinating bills of sale and transfer documentation
- Releasing funds once agreed sale conditions have been met
SafeSell acts as a marine sale facilitation business and may act as the appointed agent of the seller for the relevant transaction.
2. Our Role
SafeSell is not the seller of any vessel and is not a party to the contract of sale between buyer and seller.
SafeSell does not provide:
- Legal advice
- Financial product advice
- Finance or lending services
- A guarantee of vessel condition, title, or future performance
Any inspection report is provided by the relevant inspection provider and should be read in full by the buyer.
3. Buyer Responsibilities
Buyers are responsible for:
- Providing accurate identity and contact details
- Depositing funds in accordance with SafeSell payment instructions
- Reviewing inspection reports and sale documentation
- Completing registration transfer requirements
- Making their own decision about whether to proceed with the purchase
Buyers acknowledge that SafeSell does not warrant the condition, suitability, or future reliability of any vessel.
4. Seller Responsibilities
Sellers must confirm that:
- They are legally entitled to sell the vessel
- The vessel is free from undisclosed encumbrances or third-party claims
- All vessel, engine, trailer, registration, and ownership information provided is accurate
- They will sign required documents, including any agency agreement, bill of sale, and transfer papers
- They will cooperate with inspection, handover, and transport arrangements
5. Fees and Commission
SafeSell fees and commissions are disclosed before engagement and may be recorded in a separate service agreement, agency agreement, or quote.
Where applicable, SafeSell may deduct agreed fees, commission, or costs from funds held before remitting the balance to the seller.
Optional services, such as pre-purchase inspections, photography, advertising upgrades, detailing, or additional verification checks, may incur separate charges.
6. Trust Account Handling
Buyer funds may be received and held in a designated trust account pending completion of agreed sale conditions.
Funds are released when the required conditions are satisfied, which may include:
- Cleared funds received
- Inspection or pre-transport check completed
- Vessel ready for handover or transport
- Bill of sale and transfer documentation received
- Any other agreed sale conditions met
SafeSell is not responsible for delays caused by banks, payment processors, incorrect account details, or payment system interruptions outside our control.
7. Inspections
SafeSell may coordinate inspections through independent inspection providers, including SeaWorthy Inspections.
A pre-transport inspection is intended to confirm the condition of the vessel at collection or handover. It is not the same as a full pre-purchase inspection or marine survey.
Buyers are encouraged to arrange a detailed pre-purchase inspection where appropriate, especially for higher-value vessels.
8. Verification Checks
SafeSell may conduct or coordinate checks including:
- PPSR searches
- Vessel registration checks
- Trailer registration checks
- Seller identity verification
- Bank account verification
- Other reasonable transaction checks
These checks reduce risk but do not eliminate all risk. SafeSell relies on information available at the time of checking and cannot guarantee the completeness or accuracy of third-party databases.
9. Buyer Safeguards
SafeSell’s process is designed to reduce common risks in private vessel transactions.
These safeguards may include:
- Seller identity verification
- PPSR and encumbrance checks
- Inspection coordination
- Trust account handling
- Bill of sale documentation
- Handover and transport coordination
These safeguards do not cover latent defects, future mechanical issues, matters outside inspection scope, or issues that arise after handover.
10. Disputes
If a dispute arises, the relevant party should notify SafeSell in writing as soon as possible.
SafeSell may request evidence, pause release of funds where appropriate, and help facilitate communication between buyer and seller.
SafeSell does not act as a court, tribunal, mediator, arbitrator, or final decision-maker.
Where funds remain held, SafeSell may release funds only in accordance with:
- Joint written instructions from buyer and seller
- A court or tribunal order
- Lawful instructions permitted under the relevant agreement and applicable law
11. Limitation of Liability
Nothing in these Terms excludes any rights or guarantees that cannot be excluded under the Australian Consumer Law or other applicable laws.
To the maximum extent permitted by law, SafeSell is not liable for:
- The condition, quality, suitability, or performance of any vessel
- The accuracy or completeness of any third-party inspection report
- Transport, handling, storage, or delivery of the vessel
- Delays or failures caused by banks or payment systems
- Incorrect bank account details provided by a buyer or seller
- Acts, omissions, misrepresentations, or defaults of buyers, sellers, inspectors, transport providers, or other third parties
- Indirect, consequential, economic, or special loss
Where SafeSell is liable for a loss that cannot lawfully be excluded, SafeSell’s liability is limited, at its option, to re-supplying the relevant service or refunding the fees paid to SafeSell for that transaction.
12. Website Use
You must not use this website or SafeSell services for unlawful, fraudulent, misleading, or harmful purposes.
All website content, branding, copy, graphics, and platform materials belong to SafeSell or its licensors and may not be copied or used commercially without written permission.
13. Privacy
SafeSell collects and handles personal information in accordance with its Privacy Policy.
This may include identity information, contact details, transaction records, bank details, inspection documents, and verification records.
14. Changes to These Terms
SafeSell may update these Terms from time to time. The latest version will be published on this website.
Continued use of the website or SafeSell services after changes are published means you accept the updated Terms.
