Safe Sell Pty Ltd (“SafeSell”, “we”, “us”, “our”) is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, hold, use, and disclose personal information.

1. Information We Collect

We collect personal information that is reasonably necessary for our services, including:

  • Identity information: name, date of birth, residential address, contact telephone numbers, email address
  • Verification documents: government-issued photo ID, boating licence details, business identification where applicable
  • Vessel information: hull identification number (HIN), boat code, engine serial numbers, trailer VIN, registration details, ownership history
  • Financial information: bank account details for payment and remittance, transaction records, payment confirmations
  • Communications: emails, platform messages, telephone records (where you have been notified)
  • Technical information: IP address, device identifiers, browser type, log data, cookies

We do not store full credit card details. Card payments are processed by our payment providers under their own security frameworks.

2. How We Collect Information

We collect personal information directly from you when you register, list a vessel, make an offer, complete identity verification, or contact us.

We may also collect information from third parties, including:

  • Identity verification providers (electronic KYC services)
  • The Personal Property Securities Register (PPSR), the Australian Maritime Safety Authority (AMSA), state vessel registries, and stolen vessel registries
  • Inspection providers, including SeaWorthy Inspections
  • Payment service providers and our bank in relation to trust account transactions

3. Why We Collect and Use Information

We collect and use personal information to:

  • Verify your identity (Know Your Customer / KYC)
  • Verify vessel title, encumbrance status, and stolen-vessel status
  • Facilitate the sale of vessels between buyers and sellers
  • Receive, hold, and remit funds through our trust account
  • Coordinate inspections, transport, and document execution
  • Detect and prevent fraud, money laundering, and other unlawful conduct
  • Comply with our legal obligations
  • Communicate with you about your account, transactions, and our services
  • Improve our website and services, and (with your consent where required) provide marketing communications

4. Disclosure of Information

We may disclose personal information to:

  • The other party to a transaction (buyer to seller and vice versa) as reasonably necessary to facilitate the sale
  • Inspection providers, including SeaWorthy Inspections
  • Identity verification providers
  • Our bank, payment processors, and professional advisers (lawyers, accountants, auditors)
  • Government and regulatory bodies, law enforcement, courts, and tribunals where required by law or with your consent
  • Operators of public registers (PPSR, AMSA, state registries) for the purpose of conducting checks

5. Overseas Disclosure

Some of our service providers may store or process personal information outside Australia. Where this happens, we take reasonable steps to ensure the recipient handles your information in a way consistent with the Australian Privacy Principles.

8. Your Rights

You have the right to:

  • Request correction of personal information that is inaccurate, out of date, incomplete, or misleading

If you believe we have breached the Privacy Act or the Australian Privacy Principles, you can lodge a complaint by emailing privacy@safesell.au with the subject line “Privacy Complaint”. We will:

  • Acknowledge your complaint within 7 days
  • Investigate and respond substantively within 30 days where reasonably possible

If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by phone on 1300 363 992.

10. Notifiable Data Breaches

If we become aware of a data breach involving your personal information that is likely to result in serious harm, we will notify you and the OAIC in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The current version will always be available on our website. Material changes will be notified to registered users by email.
